Written notice of resignation should be given to the Chairman of the Parish Council and the casual vacancy is deemed to have occurred on the date of receipt of the notice. In the case of the death of a Councillor the casual vacancy occurs at the date of death.

the public notice

Upon the occurrence of a casual vacancy the clerk of the Council shall publish a Notice of the vacancy and send a copy of the Notice to the elections department. In the case of a death, the Public notice may be delayed for a respectful period. The notice must be dated with the date of the publication.

Note that in the case of a warded Parish the name of the ward must be entered (in brackets) at the top of the Notice below the name of the Parish Council; in this case, that in the second paragraph, the words "ten electors for this ward" are to be substituted for "ten electors for this Parish".

It will be seen that the Notice gives a period of fourteen days for requests to be made for an election. This period is calculated on "election days" which is different from the calendar and therefore the Notice should be kept up for at least three weeks. The actual due date (i.e. the final date) for the receipt of requests to hold an election is calculated precisely by the elections office and the Parish Clerk is advised of this date in a letter acknowledging receipt of the copy of the Notice.

If at the end of the 14-day period the elections office has not received ten or more requests from electors for an election to be held the elections office will notify the Parish Council that they should proceed to fill the vacancy by co-option as soon as practicable within a period of 60-days of the vacancy occurring. In the event that requests have been made then the election procedure must be followed.
